These are maximums. Actual penalties depend on employer size, violation history, good faith, and gravity of the hazard.

How OSHA calculates construction penalties

OSHA uses a gravity-based penalty system. Inspectors assess:

1. Severity — How serious is the potential injury? (Death, hospitalization, medical treatment, first aid)
2. Probability — How likely is the injury given current conditions and controls?
3. Number of employees exposed — More workers at risk can increase the penalty.

Penalties can be reduced for:

• Size — Small employers (under 25 employees) may see reductions up to 60%
• Good faith — Documented safety programs and training can reduce penalties up to 25%
• History — No serious citations in the past five years can reduce penalties up to 10%
