The clock
The clock starts the day after you receive the citation
- Federal OSHA gives 15 working days, not 15 calendar days. OSH Act section 10(a) (29 U.S.C. 659(a)); 29 CFR 1903.17(a); 29 CFR 1903.22(c) (Mon-Fri, exclude Federal holidays; receipt day does not count).
- FOM Chapter 7: written notice, email OK, oral does not count. OSHA cannot extend the period.
- State-plan jobsites are not automatically on the federal clock (29 CFR 1903.21).

Informal conference is optional and does not pause the clock. Schedule early enough to still contest if needed (osha.gov/abatement).

We do not file the Notice of Contest. That is a legal decision for you and your attorney.
After the fire drill, attach Provisio Core

No. Provisio EHS is not a law firm and does not provide legal advice or legal representation. We are safety consultants who help with informal-conference preparation, abatement documentation, and program stand-up. We do not promise that a citation will be dismissed, reclassified, or reduced.
How many days do I have to respond to an OSHA citation?
Federal OSHA gives 15 working days from receipt (not calendar days). The informal conference does not stop the clock. Oregon OSHA allows 30 calendar days. Cal/OSHA appeals go to the Appeals Board within 15 working days. Read the packet you received for your specific deadlines.
Can you attend the informal conference with us?
Yes, remotely or in person, at $1,500/day. In person is plus travel. We are technical support, not counsel.
Do I still have to post the citation if I contest it?
Yes. Under 29 CFR 1903.16, you must post the citation unedited until abated or for 3 working days, whichever is later. Contest does not lift posting.
